Mold has always been a common complaint among San Diego renters, but until recently there was little they could do about potentially hazardous mold in their units. Now, California state law officially considers mold a condition of substandard housing. What this means is that renters can now report the mold problems of the property to the San Diego city and county governments, which can then demand the landlord remedy the situation and fine landlords who do not comply. Mold as a health risk
In 2001, the California Department of Public Health began to studying the amount of mold needed to be present to pose a real risk to tenants. The conclusion led to health officials informing the California State legislature that they found there was no “sound science” to establish safety limits for mold in dwellings. There was, however, a consensus among medical professionals that even a limited mold presence causes asthma, allergies and respiratory infections.
After 2017, the California Department of Public Health officially states that any visible mold and mold odor in a property increases vastly increases the risk of respiratory disease in residents of that property. Mold is also linked to asthma and other respiratory problems, though many of the studies on it’s full effects are still in process.
San Diego code enforcement officers have already begun addressing mold complaints throughout the city, with enforcement plans set for the county early this year. The regulation hasn’t existed until now thanks in part to the difficulty of setting an acceptable limit of mold within a property, but under the new law enforcement officers can aid in the legal settlement of mold cases in favor of tenants.
